1. Acceptance of Terms
Welcome to species.app. By accessing or using our website at species.app (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
These Terms constitute a legally binding agreement between you and species.app ("we," "us," or "our"). We reserve the right to update these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
2. Description of Service
species.app is an online learning platform that provides flashcard-based study tools and educational content. Our Service includes:
- Access to curated flashcard decks across various subjects
- Spaced repetition learning algorithms
- Progress tracking and analytics
- Custom deck creation tools
- Premium subscription features
- Study session management
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.
3. User Accounts and Registration
3.1 Account Creation
To access certain features of the Service, you must create an account. You may register using:
- Email authentication (magic link)
- Google OAuth
- GitHub OAuth
3.2 Account Responsibilities
You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
3.3 Account Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
4. Subscriptions and Payments
4.1 Subscription Plans
species.app offers both free and paid subscription plans. Premium features require a paid subscription. Current pricing and features are available on our pricing page.
4.2 Payment Terms
- All payments are processed securely through Stripe, our third-party payment processor
- Subscription fees are billed in advance on a recurring basis (monthly or annually)
- You authorize us to charge your payment method for all fees incurred
- We reserve the right to change subscription prices with 30 days' notice
4.3 Refund Policy
Monthly Subscriptions: If you cancel your monthly subscription within 72 hours of your initial purchase, you are eligible for a full refund.
Annual Subscriptions: If you cancel your annual subscription within 14 days of your initial purchase, you are eligible for a full refund.
To request a refund, contact us at [email protected] with your account information and purchase details.
After the applicable refund window (72 hours for monthly, 14 days for annual), all subscription fees are non-refundable. We do not provide refunds or credits for partial billing periods.
Refunds are processed within 5-10 business days to the original payment method. In cases of fraudulent activity or violation of these Terms, we reserve the right to deny refund requests.
4.4 Cancellation
You may cancel your subscription at any time. Upon cancellation, you will retain access to premium features until the end of your current billing period. After cancellation, your account will revert to the free tier and you will lose access to premium features.
4.5 Free Trial
If we offer a free trial, you will have access to premium features for the trial period. Unless you cancel before the trial ends, you will be automatically charged for the subscription. The refund policy (72 hours for monthly, 14 days for annual) applies from the date of your first paid charge, not from the start of your free trial.
5. User Content and Conduct
5.1 User-Generated Content
You may create custom flashcard decks and other content ("User Content"). You retain ownership of your User Content, but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content as necessary to provide the Service.
5.2 Content Standards
You agree that your User Content will not:
- Violate any laws or regulations
- Infringe upon intellectual property rights of others
- Contain viruses, malware, or other harmful code
- Include hate speech, harassment, or discriminatory content
- Contain explicit adult content or content harmful to minors
- Promote illegal activities or violence
- Contain spam or unauthorized advertising
5.3 Content Monitoring
We reserve the right (but have no obligation) to monitor, review, and remove User Content that violates these Terms or is otherwise objectionable.
6. Intellectual Property Rights
6.1 Our Content
All content provided by species.app, including but not limited to text, graphics, logos, images, flashcard decks, software, and compilation of content (collectively, "Our Content"), is owned by species.app or our licensors and is protected by copyright, trademark, and other intellectual property laws.
6.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use the Service and Our Content for personal, non-commercial educational purposes only. This license does not include:
- Reselling or commercial use of the Service or Our Content
- Downloading or copying account information for the benefit of another party
- Using data mining, robots, or similar data gathering tools
- Reverse engineering or attempting to extract source code
7. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Use automated scripts or bots to access the Service
- Impersonate another person or entity
- Circumvent any access restrictions or payment systems
- Share your account credentials with others
- Systematically download or extract content to create a competing service or database
8. Third-Party Services
Our Service integrates with third-party services including but not limited to:
- Stripe for payment processing
- Google OAuth for authentication
- GitHub OAuth for authentication
- AWS services for email and storage
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.
9. Privacy and Data Collection
Your use of the Service is also governed by our Privacy Policy. We collect and process personal information including:
- Account information (username, email)
- Study progress and activity data
- Payment information (processed by Stripe)
- Usage analytics and performance data

10. Account Termination
10.1 Termination by You
You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the Service will immediately cease.
10.2 Termination by Us
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe:
- Violates these Terms
- Is harmful to other users, us, or third parties
- Subjects us to legal liability
- Is otherwise inappropriate or objectionable
10.3 Effect of Termination
Upon termination, all licenses and rights granted to you will immediately cease. We may delete your account and content. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
11. Disclaimers and Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
species.app DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT OF THIRD-PARTY RIGHTS
- ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
- UNINTERRUPTED OR ERROR-FREE SERVICE
- SECURITY OF DATA TRANSMISSION
We do not warrant that the Service will meet your requirements or that any errors will be corrected. Educational content is provided for informational purposes only and should not be relied upon as professional advice.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, species.app SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
This includes damages resulting from:
- Use or inability to use the Service
- Unauthorized access to your account or data
- Loss of data or content
- Errors or omissions in content
- Actions of other users
Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless species.app, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your User Content
- Your violation of any rights of another party
14. Dispute Resolution
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which species.app operates, without regard to conflict of law principles.
14.2 Informal Resolution
Before filing a claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally.
14.3 Arbitration
Any dispute that cannot be resolved informally shall be resolved through binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in court.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Updating the "Last Updated" date at the top of this page
- Sending an email notification to registered users
- Displaying a prominent notice on the Service
Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and species.app regarding the Service.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
16.4 Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.
16.5 Force Majeure
We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, or technical failures.
18. Acknowledgment
By using species.app, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not access or use the Service.
